As the aging population continues to grow, attorneys, financial advisors, aging life care managers, and other professionals are increasingly asked to provide services to clients under circumstances that suggest their clients’ mental capacity may be diminished or absent. This creates important ethical challenges for professionals who must be sensitive to the complex personal issues that often arise involving the client and often the client’s family.

Our panel consisting of an attorney, financial advisor, and aging life care manager will identify the liability issues facing practitioners failing to detect the presence of diminished capacity, the ‘red flags’ that could indicate its presence, and the guiding principles and best practices to be used when diminished capacity is detected. When you believe that your client has diminished capacity, and is at risk of substantial physical, financial, or other harm unless action is taken, it is important to recognize what protective actions you may take, those you are required to take, and the individuals or entities that exist whom you should consult.
